Waiver of subrogation is on the endorsement, not the face

The ACORD will let someone check waiver. That box is not the endorsement. If waiver of subrogation is on your requirements, you need the form — then you confirm it. Friday at 4:40 is a bad time to learn the difference.

This is not legal advice. For coverage questions, talk to your counsel or insurer.

The checkbox is a request

Waiver of subrogation means the vendor’s insurer agrees not to chase your entity after a loss, if the endorsement says so. A checked box on the certificate face is the producer saying they were asked. It is not the policy change.

Certificate holder is not coverage. Additional Insured is a different line. Do not treat one green cell as the whole requirement.

Do not let software auto-pass it

Extraction can see the box. That is useful. Turning waiver green from the face is how you get a false yes. COI Tracker will not auto-pass waiver, Additional Insured, or primary and noncontributory from a checkbox.

You confirm the endorsement. Status stays honest. If the form is missing, the row does not meet requirements.

Put it on the property that actually needs it

Some sites need waiver. Some do not. Store it on the property when a lender or owner requires it. Vendors get the request with the requirement attached. You are not hunting a shared inbox for last year’s sentence.

When the cert is short or the endorsement is missing, the product should help you chase what is missing — not email every vendor every Monday from a personal inbox.

Questions

Does a checked waiver box on the ACORD 25 mean we have a waiver?
No. Waiver of subrogation is granted by endorsement. The face of the certificate is a snapshot and a request, not the policy change.
Does COI Tracker mark waiver as passed automatically?
No. Face checkboxes never auto-pass waiver, Additional Insured, or primary and noncontributory. You confirm the endorsement.
